The Kentucky Public Utility Commission has indicated that as long as an owner is not making a profit when billing for utilities, they will not be treated as a public utility and therefore not be subjected to its rules. Therefore, with reference to the billing of utilities, the recommendation is to adhere to the Kentucky Residential and Landlord Tenant Act (“URLTA”) KRS 383 505. to 383.715. Local governments are encouraged to adopt the URLTA but not required to do so, however, if adopted they are not to amend the provisions that are adopted in any way.
